  • This Terms and Conditions applies to the services provided by Intelliworks.com.au including OpenStores shopping cart services, the OpenStores Network (www.openstores.com.au), and/or the Artist Flea Market (www.artistsfleamarket.com). By submitting your application for the services you indicate your acceptance of this terms and conditions.

  • You have to be over 18 years old to be eligible to sign up for our services. If you are under the age of 18 years, you can use this service only in conjunction with and under the supervision of your parents or guardians.

  • It is your responsibility to ensure that the content placed on the sites provided by IntelliWorks services are not contrary to law; all material you publish on the site does not infringe any other third party’s copyright or other intellectual property rights. You agree not to post or store on the services any content  which is fraudulent, obscene, pornography, defamatory, racist, lewd, lascivious, filthy, violent, or harassing.

  • You agree to indemnify IntelliWorks against all claims, actions, suits, liabilities, costs and expenses incurred on any account by IntelliWorks services as a result of the publishing of any content by the merchants. IntelliWorks services accept no responsibility or liability for any errors. You are required to check the content for errors as soon as they are placed on the services.

  • IntelliWorks endeavors to ensure the availability of the services, however, IntelliWorks can not and does not guarantee timely, secure, or uninterrupted access to our service due to numerous uncontrollable factors. IntelliWorks is not liable for any loss or damage as a result of any failure or delay in the use of the services.

  • IntelliWorks reserves the right to verify your details, or suspend your account, or/and not to publish your store data when any inappropriate content is found.

  • All free stores are required to renew the free service regularly to continue using the service. The service will be expired if the free store fails to renew as required. IntelliWorks reserves the right to remove the free store from the service without notice if the free store has expired. You agree not to use the store as the redirection page to other websites.

  • IntelliWorks reserves the right to synchronize the products or services you have placed on the OpenStores service with the OpenStores Networking (www.openstores.com.au), and/or the Artist Flea Market (www.artistsfleamarket.com). To use the free service, you agree to allow your customers to sign up for the OpenStores Networking sites from your free stores.

  • IntelliWorks will take care in ensuring the privacy and integrity of the information you provide as your details, however, the possibility exists that this information could be unlawfully observed by a third party while in transit over the Internet or while stored on OpenStores systems. Intelliworks accepts no liability should this occur.

  • You will have the access to the registered customer information when the customer has subscribed to your stores. As the customer personal information is available to you, you agree to be bound by the National Privacy Principles of the Privacy Act 1988.

  • You agree to pay the IntelliWorks service fee when you sign up for a paid plan. Service fees are charged monthly. If you fail to pay any fees before the payment date your service will be locked. If service fee is delayed for 30 days, your store may be removed from the service. The paid service stores can not downgrade to the free service. The service fees are not refundable and subject to change at any time with notice from IntelliWorks service.

  • The free services provided by IntelliWorks are based on "AS IS" basis. Any additional requirements have to be discussed separately, and charges may apply.

  • While the services are offered free of charge, there is no warranty or support guaranteed for the use of the services. Though no warranty is provided, IntelliWorks endevours to provide the best quality service as we can. You may submit the bug reports or new requirements to IntelliWorks, IntelliWorks will take all the bug reports and new requirements into consideration of the new releases. When new releases of the service are available, IntelliWorks will apply them to you as early as possible.

  • The free services are subject to change, minimum charges may apply when it is necessary to continue the services. When such situation occurs, you will be given mininum 3 months notice. Should you decide to cease using the service, IntelliWorks will provide you with your valuable customer details in the database.
